LEGAL
This Privacy Policy describes how Obsidian Digital LLC, operating as Nucleus TV (“we,” “us,” or “our”), collects, uses, and shares personal information in connection with the public Nucleus TV marketing website (the “Website”), including demo scheduling and related business inquiries.
This Policy applies to Website visitors and people who contact us or book a demo through the Website. It does not replace contractual terms that may apply to customers using Nucleus products. Product data-rights commitments for customers are described separately on our Trust page and in customer agreements.
The data controller for Website processing described in this Policy is:
Obsidian Digital LLC
Operating as Nucleus TV
Contact for privacy inquiries: legal@nucleus-tv.com (subject line: Privacy Inquiry).
We may process personal information that you provide to us and technical information collected automatically when you use the Website. Categories are described below. We do not intentionally collect special-category data (such as health, race, religion, or biometric identifiers) through this Website. Please do not include such information in free-text fields.
When you communicate with us or request a demo, you may provide information that may include:
When you visit the Website, we and our service providers may automatically collect technical information that may include:
This technical information may constitute personal data under applicable law. We do not claim that analytics or infrastructure data is always anonymous.
The Website uses Google Analytics 4 (“GA4”), operated by Google. GA4 is optional. The GA4 library is not loaded, and analytics cookies are not set by our implementation, unless you affirmatively choose Accept in our cookie banner (or later enable analytics through Cookie settings).
If you accept analytics, Google may receive information such as pages viewed, referrer, device and browser information, approximate location, IP-derived information, and cookie or client identifiers. We use this information to understand aggregate site usage and improve the Website.
Our implementation sets Google Consent Mode defaults to denied for analytics and advertising storage, loads GA4 only after analytics consent, and configures GA4 with Google Signals and ad-personalization signals disabled in code. We do not use GA4 through this Website for personalized advertising, and we do not load separate advertising tags on this Website.
You can reject analytics and continue using the Website. You can change your choice at any time using the Cookie settings link in the footer. Withdrawal stops future optional analytics collection from your browser under this implementation. It does not erase information already sent to Google; prior analytics data may be retained according to Google’s and our retention settings.
GA4 retention is configured in the Google Analytics account and should be confirmed by Obsidian Digital LLC before relying on a specific retention period in operational documentation.
Google acts as a service provider for measurement under applicable Google data-processing terms, subject to final legal characterization and contractual review.
The demo page offers scheduling through Cal.com. When you open the demo page, the Cal.com scheduler loads and your browser connects to Cal.com. A notice on that page explains this. Cal.com may receive your IP address, browser and device information, referrer information, and other technical data necessary to deliver the scheduling interface.
If you complete a booking, booking information may include name, email address, time zone, meeting selection, scheduling preferences, and information included in booking answers. We use booking information to schedule and manage the requested meeting.
Cal.com may connect to calendar, email, and video-conferencing services configured in the Cal.com account. The exact connected services must be confirmed in that account and are not listed as active here unless separately verified. Declining GA4 analytics does not prevent you from using the scheduler.
Demo requests are handled through Cal.com on the demo page. You may also contact us directly at legal@nucleus-tv.com for privacy or legal inquiries, or through other business channels we publish. We do not operate a separate first-party lead-capture form or lead-storage API on this Website.
Contact and booking-related information is retained while we are actively evaluating or maintaining a business relationship and afterward only as reasonably needed for business, legal, or dispute-resolution purposes, subject to Cal.com and our operational practices.
We may use personal information to:
We do not use the Website to run personalized advertising or cross-context behavioral advertising in the current implementation.
Where the EU GDPR or UK GDPR applies, we rely on purpose-specific legal bases, including:
We do not rely on legitimate interests to place GA4 analytics cookies before consent.
We share personal information with service providers that process it on our behalf to host the Website, provide analytics (only after consent), and provide scheduling. We may also share information if required by law, to protect rights and safety, or in connection with a corporate transaction. We do not sell personal information through this Website.
Known service providers involved in Website processing include:
Cal.com may engage further providers (for example calendar or video tools) depending on account configuration. Those downstream providers are described as “may” until confirmed in the Cal.com account.
Information may be processed in the United States and other countries. Where required, Obsidian Digital LLC uses appropriate safeguards for international transfers, such as contractual protections or another lawful transfer mechanism.
We use cookies and similar technologies as described in our Cookie Policy. Necessary storage may be used for security and consent preferences. Optional analytics cookies are disabled by default and used only after Accept.
On your first visit (and when consent expires or the policy version changes), we show a banner with Accept and Reject options of comparable prominence. You can reopen preferences anytime via Cookie settings in the footer. Rejecting analytics does not block access to the public Website. Closing or ignoring the banner is not treated as acceptance.
Deleted data may remain temporarily in backups where technically necessary. We do not claim that records are immediately or universally deleted in every system when a conversation or contract ends.
We use administrative and technical measures designed to protect personal information, including HTTPS delivery via Cloudflare. No method of transmission or storage is completely secure.
Depending on applicable law, you may have rights to access, correct, delete, restrict, or object to certain processing, to receive a portable copy of certain information, and to withdraw consent. Rights may be subject to legal limitations. To exercise rights, contact us using the privacy contact details in this Policy. We may need to verify your request.
If you are in the EEA or UK, you may have rights under the GDPR or UK GDPR, including access, rectification, erasure, restriction, objection, portability, and withdrawal of consent. You also have the right to lodge a complaint with your local supervisory authority (for example, the ICO in the UK).
California residents may have rights under applicable California privacy laws, depending on whether those laws apply to Obsidian Digital LLC and the relevant processing. Based on the current Website implementation, we do not sell personal information or share it for cross-context behavioral advertising. We do not provide advertising opt-out links for third-party ad networks because those services are not used on this Website.
The Website and our business services are intended for business users and are not directed to children under 13. We do not knowingly collect personal information from children under 13 through this Website. If you believe a child under 13 has provided personal information, contact us and we will take appropriate steps to delete it.
The Website may link to third-party sites. Their privacy practices are governed by their own policies.
The Website does not use personal information for cross-context behavioral advertising in the current implementation. Some browsers offer Do Not Track or Global Privacy Control signals. Where legally required and technically applicable, we will honor recognized opt-out preference signals. This Website does not currently implement automated GPC detection in code; optional analytics still requires affirmative Accept in our banner.
We may update this Policy from time to time. The “Last updated” date reflects the latest revision. Material changes to our cookie practices may require a new consent choice through an updated consent version. Continued use of the Website is not treated as consent to material privacy changes.
